The number of medical marijuana dispensaries licensed by the state doesn’t match up with a registry of licensed businesses in Butte-Silver Bow, a discrepancy that could indicate some are operating illegally.
But it could also mean that some dispensaries are licensed and not actively in business.
Unless the county opts to root them out, there’s no way to know.
The county has 14 business licenses on file for dispensaries; the state lists 24. According to the county treasurer’s office, any operating dispensary needs a business license.
Because information identifying specific pot providers is confidential except between law enforcement agencies and the state Department of Public Health and Human Services, the county would have to file complaints with the county attorney’s office to discover the name or location of the 10 potentially unlicensed businesses.
The head of the state’s marijuana program, Roy Kemp, called the discrepancy “a county concern.”
A representative from the county treasurer’s office was unsure whether the county would try to resolve the discrepancy.
